Implementation Guidance

A mandatory Information Standard is a standard in relation to the processing of information. They set out requirements that must be followed when health and adult social care information is used, processed and shared.

<h2>What are mandatory Information Standards</h2>

- A mandatory Information Standard is a standard in relation to the processing of information. They set out requirements that must be followed when health and adult social care information is used, processed and shared.  

- Information Standards also relate to information technology (IT), or IT services used, or intended to be used, in connection with the processing of information.

<h3>What is the legal basis for publishing an information standard</h3>

- Information Standards are published under section 250 of the Health and Social Care Act 2012, as amended by the Health and Care Act 2022 and the Data (Use and Access) Act 2025.  

- NHS England (on behalf of the Department of Health and Social Care) maintains a list of published Information Standards which are approved for publication by the Data Alliance Partnership Board (on behalf of Secretary of State). 

- The publication of an Information Standards Notice sets out the legal basis for an Information Standard, the nature of the legal duty and to whom it applies. An Information Standards Notice is accompanied by a suite of supporting documents to assist with the successful implementation of an Information Standard. 

- Providers should be aware that as amendments made by the Health and Care Act 2022 have now   commenced, you could be asked to provide information on your compliance with an Information Standard for the purposes of monitoring and compliance.

<h2>How has the law changed</h2>

- Previously, public health and adult social care providers had a statutory duty to “have regard” to Information Standards but were not obliged to comply if there was a justification.  

- However, the law has now changed which means both public and private health and adult social care providers will have a statutory duty to comply with any mandatory Information Standards that apply to them.  

- The legislative changes will also allow for monitoring and enforcement action to be taken against private health and adult social care providers where they fail to comply.  

- NHS bodies are required to comply with a mandatory Information Standard as a condition of the Provider License. 

These legislative changes are part of a wider suite of reform. Forthcoming changes will also make compliance with Information Standards mandatory for providers of information technology, IT services or processing of information using IT in the provision of health care and adult social care. 

This will ensure that both providers and IT suppliers are working towards a consistent set of rules – making seamless and safe information exchange possible across the health and adult social care system.

<h3>Why were these changes necessary</h3>

- Providers and IT suppliers have told us that they would welcome greater clarity on priority Information Standards and where they should apply. 

- Inconsistent adoption of Information Standards continues to limit seamless data sharing between health and adult social care providers.  

- By strengthening previous legislation, we can enforce compliance with priority Information Standards and ensure that information can be shared more effectively across our health and adult social care system.

<h4>What do providers need to do</h4>

An Information Standard Notice will set out the statutory duty that is placed on providers. Providers are then required to meet their statutory duty to comply with a mandatory Information Standard within the specified timeframes. 

Providers should be aware that they could be asked to provide information on their compliance with Information Standards for the purposes of monitoring compliance. 

NHS bodies are required to comply with an Information Standard Notice as a condition of the Provider License. In the future, private providers may face enforcement action if they fail to evidence compliance with mandatory Information Standards within the specified timeframes.  

Enhanced assurance of Information Standards will ensure that consideration has been given to how conformance will be monitored and enforcement action taken - and to ensure that the statutory duty that is being placed on providers is realistic and achievable.

## Standard definition

This information standard aims to make sure that people who have a disability, impairment or sensory loss get appropriate information and communication support from NHS and adult social care services.

 It requires all applicable organisations to identify, record, flag, share and meet the information and communication support needs of patients, service users, carers and parents with a disability, impairment or sensory loss.

Successful implementation will lead to improved outcomes and experiences, and the provision of safer and more personalised care and services to those individuals who come within the scope of the standard.

## About this change

The standard has been updated following a post implementation review undertaken in early 2017. Changes to the standard include:
* Updates to the meaning of certain terms used, including changes to the definitions for �parent� and �highly visible�. 
* Amendments relating to mental health service users and the Mental Capacity Act 2005, to improve clarity, especially regarding support for people who may lack capacity.
* Inclusion of advice regarding support for individuals with a learning difficulty.
* Updates to reflect the current position regarding the inclusion and transfer of data recorded using existing systems.

The revised Implementation Guidance reflects these updates and also includes additional guidance on sharing of information (including consent), use of email / text message to communicate with patients / service users, parental responsibility, and to address some other specific queries that have been raised about interpretation. There are no substantive amendments to the Requirements of the Standard and no substantive changes to the overall scope.

Applies to: This standard applies to � and therefore must be implemented and adhered to by � ALL providers of publicly-funded NHS, public health and adult social care services.

Effective implementation will require such organisations to make changes to policy, procedure, human behaviour and, where applicable, electronic systems

Impacts Upon: Commissioners must ensure that their commissioning and procurement arrangements with providers of health and / or adult social care reflect, enable and support implementation and compliance with this standard. They must also seek assurance from providers of their compliance with this standard.

Implementation of this standard impacts all suppliers providing systems to the above providers; suppliers should work with their customers to determine appropriate use

This process of collecting data for advertising purposes is not controlled by the NHS Standards Directory, and we do not have access to the profiling data stored by social networks about you.


## Keeping your personal data secure

We convert your data into secure code (encrypt it) and store it on secure servers in England. A partner organisation is providing hosting services but has no say in how the information is used. There are no legal ways for their employees to see the data. Only approved people in the NHS Standards Directory team can see it.

If you shared your email with us as part of a survey, we will delete it after 2 years. At that point no one can identify you in the survey data.

The directory is a source of recognised standards used by technologies in health and adult social care to exchange data in England. 

It is a signposting service only. It doesn�t include the full documentation for each standard. This can be found on the standard owner�s website.

## Who this service is for

This service is for anyone building or buying digital technologies for the NHS or local authority-funded adult social care services in England. 

This includes IT suppliers, healthcare providers and technology buyers such as procurement teams and framework operators.

## What standards are included

The directory lists all standards that are mandated at a national level as well as some standards that are not mandatory but are widely in use in England. These include: 

* all approved national [information standards](https://digital.nhs.uk/data-and-information/information-standards/information-standards-and-data-collections-including-extractions/publications-and-notifications/standards-and-collections#approved-standards-and-collections). These are assured by the [Data Alliance Partnership Board](https://digital.nhs.uk/data-and-information/information-standards/information-standards-and-data-collections-including-extractions/data-alliance-partnership-board) and issued with an Information Standard Notice, which means they are mandatory.

## What we mean by standards
This service contains standards, which we group into 4 categories:

*   **A Collection** is a systematic gathering of a specified selection of data or information for a particular stated purpose from existing records held within health and care systems and electronic devices.

*   **An Extraction** is a type of collection that is pulled from an operational system by the data controller and transmitted to the receiver without additional processing or transcription by the sender..

*   **Technical standards and specifications** specify how to make information available technically including how the data is structured and transported

* **Information standards** are agreed ways of doing something, written down as a set of precise criteria so they can be used as rules, guidelines, or definitions.

## Benefits of using standards
There are many benefits to using standards including:

* it�s more efficient to reuse existing approaches to recording or exchanging data than creating new ones
* it promotes quality by ensuring all care settings are aligned to standards that have been approved by qualified bodies
* it makes it easier to analyse data at the national level and see trends or problems if the data has all been standardised 
* it is essential to achieving interoperability, which would allow IT systems across the country to share data. An example of this is hospitals being able to update GP records directly using their own systems instead of sending emails

## Report a gap in standards
Work is underway to publish a process for people developing new standards. 

In the meantime, please notify us of plans to create new standards by emailing england.interop.standards@nhs.net. Local standards that apply at the national level may be uplifted for national use.
